General conditions of sales for Bed & Breakfast stay at 

CoMuNREVE Guest House

 

OBJECT

These general terms and conditions of sales are intended for use in booking stays in guest rooms and associated services at the CoMuNREVE Guest House - 38 chemin des Ruchers - Les Champs - 73220 SAINT-ALBAN-D'HURTIERES (FRANCE). These general terms and conditions of sale and the booking form constitute the booking contract for a stay in a guest house between the following parties:

  • The CoMuNREVE Guest House represented by Cosimo PALMITESSA, on the one hand,

  • The holder of the reservation, hereinafter referred to as the Customer, on the other hand,

The present general terms and conditions of sale define the rights and obligations of each party and regulate all the steps necessary for the reservation and follow-up of the reservation between the contracting parties.

Acceptance of and compliance with the general terms and conditions of sale and the various rules and regulations of the CoMuNREVE Guest House are acquired upon payment of the reservation. The present conditions of sale may be modified at any time without prior notice. In this case, the CoMuNREVE Guest House will notify the Customer of the modifications by e-mail before the start of the services. The new version of the GCS will then apply to the relationship between the parties. 

HOSPITALITY

Customers will receive the best of welcomes. Hosts commit themselves to providing a personal welcome with all the attention required to facilitate their stay. 

Rooms and bathrooms are cleaned daily at no extra charge. For stays of several nights and for environmental reasons, bed linen is changed weekly, unless the Customer expressly requests otherwise.

The bed and breakfast rental business is a commercial activity and is registered with the RCS (Registre du Commerce et des Sociétés), SIRET number 943 297 085 00012.

The guest rooms comply with the provisions of articles D. 324-13 and D. 324-14 of the French Tourism Code.

DURATION OF STAY

The present contract, accepted by the Customer, is concluded for a period determined at the time of reservation. Under no circumstances may the Customer claim any right to remain in the premises at the end of the stay.

PRICES

The prices indicated on the www.comunreve.com website and displayed on site are the only contractual rates. Prices are quoted in euros, including VAT, per room and per night, for the number of people and dates indicated on the booking form. These are the prices for bookings made directly with the CoMuNREVE Guest House, without any intermediary. 

Breakfast, bed linen, towels and cleaning are included in the price. 

Prices include all taxes but exclude tourist tax. 

VAT is applied on the day of booking, and any change in the VAT rate will be automatically reflected in the prices indicated on the invoice date. 

Tourist tax is payable directly to the CoMuNREVE Guest House at the end of your stay and will be indicated for information purposes at the time of booking. 

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated at the time of invoicing. All bookings, whatever their origin, are payable in the local currency of the CoMuNREVE Guest House, i.e. in Euros (€). In the event of a debit to the CoMuNREVE Guest House in a currency other than that confirmed on the reservation, exchange charges will be billed to the Customer.

BOOKING

The Customer acknowledges that they have read and understood the nature, purpose and booking terms of the services available on the CoMuNREVE Guest House booking platform, and that they have requested and obtained the necessary and/or additional information to make their booking with full knowledge of the facts. The Customer is solely responsible for his choice of services and their suitability for their needs, such that the responsibility of the CoMuNREVE Guest House cannot be sought in this respect. The reservation is considered accepted by the Customer at the end of the reservation process.

BOOKING PROCESS AND PAYMENT TERMES

  • Online booking

Reservations are made online by the customer via the CoMuNREVE booking platform. Prior to any reservation, the Customer is required to complete the information requested on the reservation form. 

The Customer is required to provide a valid e-mail address and cell phone number. The Customer attests to the truthfulness and accuracy of the information provided. 

The CoMuNREVE Guest House invites the Customer to check the following elements:

- Contact details - in particular e-mail address and cell phone number - in order to be reachable before and during the booking.

- Room(s) booked, number of people, arrival date, departure date, number of nights.

- The total price of the reservation, the amount indicated being inclusive of tax.

If the reservation meets expectations, the customer must pay the full amount of the service reserved within one hour.

Once the final choice of services has been made, the booking procedure includes:

- Consultation and acceptance of the terms and conditions of sale for the rate booked, as well as the general terms and conditions of sale,

- Entering your credit card details for full payment of the price of your stay.

The CoMuNREVE Guest House has chosen Crédit Agricole's E-Commerce CAWL offer to secure online payments by credit card. The validity of the Customer's payment card is verified by Crédit Agricole. A payment card may be refused for several reasons: stolen card, blocked card, credit limit reached, input error, etc. In the event of a problem, the customer must contact their bank on one hand, and the CoMuNREVE Guest House on the other, to confirm their reservation and method of payment.

At the end of the reservation process described above, the reservation is deemed effective.

The reservation platform acknowledges receipt of the Customer's reservation by automatically sending a confirmation e-mail. This confirmation e-mail summarizes the services booked, the prices, the booking dates, the general terms and conditions of sales and the address of the CoMuNREVE Guest House.

The Customer may also, at any time, access their customer account created at the time of booking and retrieve their reservation.

  • Other booking methods (telephone, e-mail, on-site)

The CoMuNREVE Guest House fills in the booking form itself, based on the information previously provided by the Customer, and sends the Customer confirmation of the pre-reservation (via e-mail), together with the terms and conditions of sale for the rate booked, pending payment. 

The customer must accept the terms and conditions of sale and pay for the entire reservation within 24 hours of the e-mail being sent, using the following payment methods:

- Online payment by credit card, via the payment solution offered by Crédit Agricole ;

- CoMuNREVE Guest House will send you a secure payment link ;

- Bank transfer - exclusively in euros, charges to be paid by the client - IBAN of CoMuNREVE Guest House sent on request ;

- Cheque (bank domiciled in France), payable to Cosimo PALMITESSA ;

- “Chèques-vacances” ;

- Cash (Euros only).

The reservation is registered and confirmed once full payment has been received. Please note that in the absence of payment within the stipulated period, the reservation is not confirmed and, consequently, the CoMuNREVE Guest House reserves the right to re-let the room.

PAYMENT OF ADDITIONAL SERVICES

Additional services consumed on site must be paid for at the time of departure (table d'hôtes, drinks, embroidery workshop, late check-out option, etc.) by credit card, cheque or cash (euros only). Failure to make a written objection (within 24 hours) to the service provided implies full payment at the advertised price.

An invoice is given to the customer on departure, detailing the service provided, the amount of the stay, the amount of any additional services, and the amount of the tourist tax.

TOURIST TAX

The tourist tax is a local tax that the Customer must pay to the owner, who then passes it on to the Porte de Maurienne Community of Communes. The tourist tax finances the costs of facilities, signage, reception conditions and promotion of our region. It is payable on site, at the end of your stay.

In compliance with article L 2333-29 et seq. of the Code Général des Collectivités Territoriales, the tourist tax is payable per night (per night per person), from January 1 to December 31 inclusive.

The rates set since 29/09/2018 are €0.88 per night per person. Minors, holders of a seasonal employment contract employed on the territory of the EPCI, people benefiting from emergency accommodation or temporary rehousing as well as people owning a residence for which they are liable to the taxe d'habitation (local residence tax) are exempt.

NO RIGHT OF WITHDRAWAL

In accordance with article L. 121-21-8 12° of the French Consumer Code, customers are reminded that they do not have the right of withdrawal provided for in article L. 121-21 of the French Consumer Code.

CANCELLATION / MODIFICATION BY THE CUSTOMER

The conditions of sale of the rate reserved specify the terms of cancellation and / or modification of the reservation. When the conditions of sale of the reserved rate allow it, the Customer must notify his cancellation request by registered letter or by e-mail to the CoMuNREVE Guest House. All reservations are nominative and may not be transferred to a third party, whether free of charge or in return for payment.

  • Cancellation by the Customer

The CoMuNREVE Guest House draws the Customer's attention to the fact that no cancellation insurance is included in its rates. It is therefore strongly recommended to purchase such insurance. In the event of any difficulty, the customer is advised to contact CoMuNREVE immediately by telephone: +33 (0)6 26 32 60 32 or by e-mail: contact@comunreve.com.

The full amount of the booking remains the property of the CoMuNREVE Guest House in the event of cancellation by the customer for any reason whatsoever.

In the event of cancellation of a table d'hôte or additional activity within less than 48 hours, full payment is due.

  • Exclusions to the application of cancellation conditions

Death of a family member: a death certificate and proof of family relationship must be provided, 

Unexpected hospitalization of the customer or a family member: a hospital admission certificate specifying the reason for admission must be provided, 

Major disaster at the customer's main residence (fire, destruction, burglary): proof to be provided.

  • No Show (booking not cancelled – Customer not present)

If the Customer does not show up before 10:00 pm on the day scheduled for the start of the stay, the contract becomes null, and void and the owner may dispose of his rooms. The full amount of the stay (accommodation and services paid where applicable) remains the property of the CoMuNREVE Guest House.

  • Shortened stay

The full amount of the stay (paid or unpaid accommodation and services) remains the property of the CoMuNREVE Guest House.

CANCELLATION / CHANGE MADE BY THE COMUNREVE GUEST HOUSE 

If, before the start of the stay, the CoMuNREVE Guest House is obliged to cancel the reservation, they must inform the Customer by e-mail or telephone. Without prejudice to any claims for damages, the Customer will be reimbursed immediately for any sums paid, without compensation. Without the Customer being entitled to claim any compensation, the CoMuNREVE Guest House reserves the right, should it be obliged to do so, to change the room initially booked by the Customer for a room of the same category. In such a case, the cost of the reservation will remain unchanged.

POSTPONEMENT OR CANCELLATION DUE TO AN ADMINISTRATIVE TRAVEL BAN

In the event of an administrative travel ban imposed by the authorities in connection with a pandemic (“lock-down”), making it impossible for the Customer to travel to their place of stay, or making it necessary to interrupt his or her stay, the Customer may cancel all or part of his or her stay free of charge. The CoMuNREVE Guest House then undertakes to reimburse the customer for all sums paid for unused services during the stay. In agreement with the CoMuNREVE Guest House, a postponement solution may also be considered, free of charge. 

This condition of cancellation or postponement without charge does not apply in the following cases: curfew, closure of stores, bars, restaurants, shows or various events, COVID illness (or other pandemic) of one of the travelers or if one of them is a contact case. It applies only in the event of an administrative travel ban imposed by the authorities.

SERIVE CONSUMPTION

  • Police form

In accordance with current regulations (article R 611-42 of the French Code de l'Entrée et du Séjour des Etrangers et du Droit d'Asile), foreign customers will be asked to complete a police form on arrival.

To do this, the Customer will be asked to show proof of identity to verify whether or not they are required to complete the police form. The CoMuNREVE Guest House will keep a copy for the duration of the stay.

  • Arrival / Departure times 

Arrival: between 4:00 pm and 6:30 pm.

The Customer must arrive between 4:00 pm and 6:30 pm on the day of booking. The Customer will be asked for an approximate arrival time so that they can be welcomed in the best possible conditions. For any arrival outside this time slot, the Customer must request prior agreement from the CoMuNREVE Guest House. The Customer is expressly requested to contact the CoMuNREVE Guest House by telephone on +33 (0)6 26 32 60 32 to report any delay.

Departure: before 10:30 a.m.

On the day of departure, the Customer must vacate the room by 10:30 am at the latest. On prior request and with the agreement of the CoMuNREVE Guest House, a late check-out and breakfast may be offered until 1:00 pm, subject to a flat rate of €20 (euros)/room. Any departure after this time without prior agreement from the CoMuNREVE Guest House may result in the invoicing of an additional night.

  • Breakfasts

Breakfast is served in the shared living area from 7 a.m. to 10 a.m. (except for late departures at extra charge). Breakfast times can be moved forward on request (hikers, etc.).

  • Table d’hôtes

Table d'hôtes bookings must be made 48 hours in advance. Dinner is served at the guest table for all guests at 7:30 pm (aperitif from 7:00 pm). The menu consists of an amuse-bouche accompanied by a glass of wine or Crémant de Savoie, a beer or a local soft drink, a main course, a cheese platter and a dessert. Additional drinks are extra; coffee, tea or herbal tea are included.

  • Use of premises 

The best welcome will be given to guests. Hosts undertake to personally welcome guests with all due attention to facilitate their stay.

To ensure the tranquility of the premises and the comfort of guests at the CoMuNREVE Guest House, a certain “art de vivre” is required of everyone. The guest undertakes to comply with the instructions given to them, as well as with the present general conditions of sale. In particular, smoking and vaping are not permitted indoors (rooms, shared areas, etc.) or at the windows, and not to light candles.

Picnics may be taken on the terrace or in the common room, but under no circumstances in the rooms.

Any behavior contrary to public morality and order will lead the CoMuNREVE Guest House to ask the Customer to leave the CoMuNREVE Guest House without any reimbursement or indemnity.

The Customer has free access to the room he occupies as well as to any common space during his stay, without time limitation. Consequently, in the event of late-night re-entry to the premises, it is requested that the utmost silence be maintained for the peace and quiet of all.

Please do not flush anything down the toilet, and do not use towels to remove make-up or clean shoes. The CoMuNREVE Guest House reserves the right to charge the cost of replacing towels and/or linen stained by these products.

As the reservation is nominative, the premises may under no circumstances be used by a third party. Only persons staying in the CoMuNREVE Guest House are authorized to use the shared areas.

Please note that the kitchen in the guest house is not at the free disposal of guests. On request, guests may have access to a microwave, a shared refrigerator and a washing machine (at an extra charge).

The CoMuNREVE Guest House offers parking spaces for tourist vehicles in front of the house, without prior reservation (one space/room). 

The CoMuNREVE Guest House is not liable for loss, theft and/or damage or injury to property and/or persons on the property, however caused.

  • Capacity

Bookings are made for a specific number of people. The CoMuNREVE Guest House has the right to refuse any additional person. This refusal cannot be assimilated to a modification of the contract on the initiative of the CoMuNREVE Guest House, so that in the event of departure of the Customer for this reason, no refund can be considered.

  • Animals

Animals are not allowed. The CoMuNREVE Guest House therefore has the right to refuse to accept a guest staying with an animal, even if it is a pet. This refusal cannot be assimilated to a modification of the contract on the initiative of the CoMuNREVE Guest House, so that in the event of departure of the Customer for this reason, no refund can be considered.

Two cats and a dog live in the CoMuNREVE Guest House but are not allowed in the rooms. The guest rooms are not considered as ERP (Etablissement Recevant du Public); however, the CoMuNREVE Guest House accepts guide or assistance dogs after prior agreement and provision of proof. However, any animal accepted in the rooms must not, under any circumstances and at any time, remain alone and locked up in the room in the absence of its owners. Dogs must be kept on a leash on the property. Pet owners must ensure that their pets leave the premises clean and clean up any droppings in the areas loaned and in the garden.

LIABILITY

The photographs presented on the CoMuNREVE Guest House booking platform are not contractually binding. Although every effort is made to ensure that the photographs, graphics and texts reproduced to illustrate the CoMuNREVE Guest House give as accurate an idea as possible of the services offered, variations may occur between the time of booking and the day of consumption of the service. The CoMuNREVE Guest House cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the fault of a third party, the fault of the customer, in particular the unavailability of the internet network, external intrusion, computer viruses or in the event of unauthorized prepayment by the bearer's bank. Any reservations or payments that are irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the Customer's expense, without prejudice to any civil or criminal action against the latter.

INSURANCE

The Customer certifies that they are covered by an insurance policy covering their personal liability and that of their family.

The CoMuNREVE Guest House certifies that it is covered by an insurance policy covering its Professional Civil Liability arising from its bed and breakfast activity.

Guests' attention is drawn to the fact that minors on the property are the sole responsibility of their parents or guardians. Children must always be accompanied by an adult in the CoMuNREVE Guest House. 

The customer undertakes to return the rooms in perfect condition and free of damage at the end of the stay, and to declare systematically - and assume financially - any damage for which he/she is responsible. The cost of repairs, including the time required to restore the property, will be invoiced separately and paid for on the basis of receipts for the costs incurred. Customers are asked to respect the objects made available to them. Any undeclared missing object will be invoiced to the customer at its replacement value.

The CoMuNREVE Guest House reserves the right to take legal action against the customer.

If an item is left in the room at the end of the stay, it can be sent to the person concerned, at their request and expense.

LITIGATION

These General Terms and Conditions of Sale are governed by French law. Claims relating to the non-performance or improper performance of the services booked must, under penalty of foreclosure, be brought to the attention of the CoMuNREVE Guest House in writing within eight days of the date of departure from the CoMuNREVE Guest House.

RESPECT FOR PRIVACY

The Customer is informed, on each of the forms for the online collection of personal data, of the compulsory or optional nature of the answers by the presence of an asterisk. The CoMuNREVE Guest House collects information for administrative (e.g. police forms) and practical purposes, and requests first names, last names and citizenships, as well as children's ages (e.g. for calculating tourist taxes) of all guests. E-mail addresses are also stored. All this data remains confidential and is used only for the internal use of the CoMuNREVE Guest House, within the framework of the contractual relationship, and will not be communicated to third parties under any circumstances, except at the request of the authorities (police files). They are kept for 5 years after the end of the contractual relationship. 

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, customers have the right to access and rectify data concerning them.

The site does not use cookies or similar technologies.

Bank details are not stored by the CoMuNREVE guest house.

PROOF AGREEMENT

The entry of the required banking information, as well as the acceptance of the present general terms and conditions and of the reservation request, constitute an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized registers stored in the computer systems of the CoMuNREVE Guest House will be kept in reasonable conditions of security and considered as proof of communications, orders and payments between the parties. Customers are informed that their IP address is recorded at the time of booking.

FORCE MAJEURE

Force majeure refers to any event outside the control of the parties that is both unforeseeable and insurmountable, preventing either the Customer or the CoMuNREVE Guest House from fulfilling all or part of its obligations under the contract. Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of the French Courts and Tribunals. Each party may not be held liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends the parties' performance of their mutual obligations, and that each party shall bear the costs arising therefrom.

WHOLENESS

The reservation form, the general conditions of sale and the regulations in effect at the CoMuNREVE Guest House form an indivisible whole which is accepted in its entirety upon payment of the reservation by the Customer. These elements constitute the entirety of the obligations of the parties. No general or specific condition communicated by the Customer may be integrated into the present general sales conditions. The documents forming the contractual commitments between the parties are, in decreasing order of priority, the reservation request (including the specific conditions of the fare booked) and these general sales conditions.

INTERNET USAGE RULES

  • Internet access

The internet access provided to the Customer during their stay is shared with the internet access used by the CoMuNREVE Guest House. The specifications are those provided by the ISP (Internet Service Provider). The Customer can connect via wired RJ45 connections in their rooms and via Wi-Fi in shared areas. These services are offered free of charge, subject to equipment compatibility.

  • CoMuNREVE Guest House Wifi access code 

Wifi access code will be given upon demand.

  • Code of good conduct

Proper use of the Internet: the Customer declares that they accept the specific features and limits of the Internet. In particular, they acknowledge that the community of Internet users has developed a code of good conduct with which they declare they are familiar, and consequently accept that transgression of this code may result in exclusion from access to the Internet, for which the CoMuNREVE Guest House may not be held responsible. The user also acknowledges that data circulating on the Internet must not contravene national or international laws, regulations, charters of practice or ethics in force. As data circulating on the Internet may be regulated in terms of use or protected by property rights, the Customer is solely responsible for the use of data he consults, stores and transports on the Internet. Similarly, as data circulating on the Internet network is liable to be hijacked, the communication by the Customer of confidential data (credit card code, for example) is made at the Customer's own risk.

Respect for Netiquette and laws and regulations: Netiquette is a code of good conduct drawn up by the Internet community. Failure by the Customer to comply with Netiquette may result in reactions from other Internet users, for which the CoMuNREVE Guest House cannot be held responsible. Furthermore, the Customer shall refrain from publishing, by any means whatsoever, any content contrary to public order, in particular and without limitation, content of a paedophilic or pornographic nature, inciting to suicide, racial hatred or the commission of xenophobic or anti-Semitic crimes or offences, or infringing on the right to a person's image or privacy. The Customer also undertakes not to infringe the property rights of others, in particular and without limitation, to disseminate content infringing intellectual and industrial property rights. The CoMuNREVE Guest House may transmit the Customer's contact details in the event of an investigation, in compliance with the law. Connection histories are kept for one year.

“Spamming” and chain letters: the use by the Customer of the CoMuNREVE Guest House Internet access service for fraudulent or harmful purposes, such as, in particular, sending unsolicited messages in large numbers and other ‘spamming’ type activities, is strictly forbidden.

Piracy and hacking: the Customer undertakes not to use the Internet service provided by the CoMuNREVE Guest House for the purposes of piracy, intrusion into computer systems or “hacking”, as well as any other act reprehensible under civil or criminal law.
